Estimates, Proposals, and Service Agreements

Specific project details may be governed by a separate written estimate, proposal, invoice, scope of work, contract, change order, warranty, or service agreement.

Fence Ace may rely on the information you provide when preparing an estimate or planning a project. Inaccurate, incomplete, or changed information may affect pricing, scheduling, materials, or the feasibility of the project.

Property Ownership and Authorization

By authorizing work, you represent that you own the property or have permission from the property owner or other authorized decision-maker to request and approve the work.

You are responsible for obtaining any necessary permission from property owners, landlords, homeowners’ associations, community associations, neighboring property owners, property managers, or other parties whose authorization may be required.

Property Lines, Surveys, and Fence Placement

Unless Fence Ace expressly agrees otherwise in writing, the customer is responsible for identifying and confirming property lines, easements, setbacks, restricted areas, and the desired fence location.

Fence Ace may recommend that the customer obtain a current survey or other professional boundary information before installation. Fence Ace is not a licensed land-surveying company and does not establish legal property boundaries.

Fence placement based on customer-provided directions, markings, surveys, diagrams, or representations remains subject to the applicable project agreement and legal requirements.

Permits, Associations, and Governmental Requirements

Fence projects may be subject to permitting, zoning, setback, height, visibility, pool-safety, building-code, association, or inspection requirements.

Responsibility for permits, applications, surveys, approvals, notices, inspections, and related fees will be determined by the applicable written estimate or service agreement.

Customers are responsible for providing accurate ownership information, signatures, surveys, association documents, or other materials reasonably needed to complete required applications or approvals.

Fence Ace does not guarantee that a governmental authority, association, or other third party will approve a requested fence design, location, height, material, or project.

Utilities and Underground Conditions

Fence installation may involve digging, drilling, post placement, and ground disturbance. Utility-location services may identify certain public underground utilities, but they may not identify privately installed or customer-owned systems.

The customer must disclose known private underground conditions, including irrigation systems, low-voltage wiring, pool equipment lines, septic systems, drainage systems, invisible pet fencing, landscape lighting, and other private installations.

Responsibility for unknown or undisclosed underground conditions will be governed by the written project agreement and applicable law.

Site Access and Preparation

The customer agrees to provide Fence Ace and its authorized workers with reasonable access to the property during scheduled measurements, deliveries, installation, repairs, inspections, and related work.

Unless otherwise agreed in writing, the customer is responsible for:

• Providing safe and reasonable access to the work area
• Unlocking gates or arranging authorized access
• Keeping pets and animals safely away from the work area
• Removing personal property or obstacles that interfere with the work
• Identifying known hazards or unsafe conditions
• Informing household members, tenants, workers, or other occupants about scheduled work

Materials and Product Availability

Fence materials, colors, styles, hardware, accessories, and products may be subject to manufacturer availability, supplier inventory, transportation delays, discontinued products, and market conditions.

Photographs, samples, website images, manufacturer images, and digital representations are provided for general reference. Actual materials may vary in texture, grain, shade, finish, appearance, or other natural and manufacturing characteristics.

Any substitution of material or material-related price adjustment will be addressed in accordance with the applicable estimate, proposal, or change order.

Scheduling and Delays

Project dates and completion timelines are estimates unless a specific deadline is expressly guaranteed in a written agreement.

Scheduling or completion may be affected by circumstances including:

• Weather, storms, flooding, excessive rain, wind, or unsafe conditions
• Material or equipment availability
• Permit, inspection, or association-approval delays
• Utility-location delays
• Unexpected site or underground conditions
• Customer-requested changes
• Restricted or unavailable property access
• Labor, transportation, manufacturer, or supplier disruptions
• Events outside the reasonable control of Fence Ace

Fence Ace will make reasonable efforts to communicate material scheduling changes, but is not responsible for delays caused by circumstances outside its reasonable control.

Changes to the Project

Changes requested after an estimate, proposal, or project agreement has been approved may affect pricing, materials, permits, and scheduling.

Additional work, changed dimensions, upgraded materials, revised fence placement, additional gates, removal work, or other modifications may require a written change order or revised agreement.

Fence Ace is not obligated to perform work outside the agreed scope without written approval and agreement on any additional cost or schedule impact.

Pricing and Payment

Pricing, deposits, payment schedules, financing arrangements, accepted payment methods, late-payment terms, and other financial requirements will be stated in the applicable estimate, invoice, proposal, or service agreement.

Unless otherwise stated in writing, payments are due according to the terms presented at the time the project or service is approved.

The customer is responsible for reviewing the project description, quantities, specifications, pricing, and payment terms before accepting an estimate or authorizing work.

Cancellations and Refunds

Cancellation, rescheduling, deposit, special-order material, restocking, and refund terms may vary by project and will be governed by the applicable estimate, proposal, invoice, or service agreement.

Customized or specially ordered materials may be nonrefundable once ordered, manufactured, prepared, or delivered, where permitted by law and as disclosed in the applicable written agreement.

User-Submitted Information

When you submit information through our website, forms, quote tools, chat features, scheduling systems, email, text messages, or other communication channels, you represent that:

• The information is accurate to the best of your knowledge
• You have the authority to provide the information
• Your submission does not violate another person’s rights

SMS and Text Messaging Terms

Fence Ace, LLC operates an SMS messaging program for customers and individuals who directly provide their mobile phone number and affirmatively opt in to receive text messages.

Providing a telephone number by itself does not automatically constitute consent to receive promotional text messages. SMS consent is collected through an optional consent-based method, such as an unchecked website checkbox, chat widget, booking form, or another documented opt-in process.

Depending on the optional consent selection you make, messages from Fence Ace may include:
